United Therapeutics and Liquidia Just Ended Their Patent War. Liquidia Stock Popped 42%
A patent court ruling wiped out nearly half of Liquidia's stock value in a single day, and the settlement that followed cost the company almost every dollar it had in the bank. Whether that price was a bargain or a…
After the market closed on October 13, 2026, Liquidia (NASDAQ:LQDA) settled every pending lawsuit with United Therapeutics (NASDAQ:UTHR | UTHR Price Prediction) for net payments totaling $380.7 million. Its stock rose 42.60% to $38.23 as of 7:59 p.m. Eastern. That gain came even though the bill represents about 16% of its $2.40 billion market value and the deal removes an approved use from its only drug.
The jump shows what investors feared. A September 30, 2026 ruling found the asserted patent claims valid and infringed, so YUTREPIA, an inhaled dry-powder form of treprostinil, could have been pulled from the market entirely. Paying a known cash cost to remove that possibility is worth more to shareholders than the cash itself.
United Therapeutics barely moved, rising 0.33% after hours to $545.22. That quiet reaction suggests investors had largely expected this outcome.
What Liquidia Signed Away
Six matters will be dismissed with prejudice, which means they can never be refiled. They include three patent cases, two North Carolina trade secret and contract cases, and a New Jersey antitrust case along with its appeals.
Liquidia pays a $175 million net payment within thirty business days, plus two installments of $72.7 million due by January 31 and April 30, 2027. Another $60.3 million goes to other parties in the antitrust case, so United Therapeutics does not collect that money.
Liquidia also made permanent concessions. It filed to remove pulmonary hypertension with interstitial lung disease (PH-ILD), which is high lung-artery pressure caused by lung scarring, from the YUTREPIA label. It also stopped promoting that use, dropped its appeal, and ended its Treprostinil Injection promotion deal with Sandoz. Neither side admitted liability.
How the Payments Stack Up Against Cash
Finance chief Michael Kaseta cited preliminary third-quarter YUTREPIA net sales of $222.7 million and cash of $396.1 million at September 30. The settlement represents about 96% of that cash and about 1.7 times one quarter of sales.
Kaseta said, “We expect to rebuild our cash position and fund our planned clinical studies without requiring additional financing.” That holds only if sales keep growing. Liquidia gave up PH-ILD, a population of more than 60,000 U.S. patients, larger than the 45,000 diagnosed pulmonary arterial hypertension (PAH) patients it keeps. That reduces the revenue ceiling for YUTREPIA.
Why United Therapeutics Barely Moved
The cash is small for a $23.31 billion company. The bigger gain is commercial, because Nebulized Tyvaso sales fell 18% to $126.0 million in the second quarter as competition took share. Its shares gained 9.31% over the past month, which suggests investors had already priced in a win after the September ruling.
Liquidia fell 57.19% on the ruling, from $70.69 to $30.26, which our earlier coverage detailed. It still sits about 46% below its September 29 close after the jump, and after-hours trading can be thin.
What Liquidia Investors Should Weigh After the Settlement
The settlement removed the worst outcome. But at $38.23, the stock prices in a business limited to PAH, with nearly all of its cash going to legal payments through April 2027. Liquidia did not disclose how much of its third-quarter sales came from PH-ILD patients.
United Therapeutics holds the stronger position in this market. It keeps its patents. It now faces no YUTREPIA competition in PH-ILD, and has applications pending for ralinepag tablets in PAH and Nebulized Tyvaso in idiopathic pulmonary fibrosis, with potential approvals by next year.
Liquidia’s next quarterly report will test this view. If Liquidia’s next quarterly YUTREPIA sales fall below the $222.7 million third-quarter figure that Michael Kaseta cited, losing PH-ILD is hurting sales. If sales top that figure and the January 31, 2027 installment is paid without new financing, this view was wrong.
