In a preliminary ruling today, a German court has said that the design of the Galaxy Tab 10.1 from Samsung Electronics (OTC: SSNLF) does not infringe on the “legally protected” design of the iPad from Apple Inc. (NASDAQ: AAPL). Samsung’s tablet uses the Android operating system from Google Inc. (NASDAQ: GOOG), the company that most observers believe is Apple’s real target.

Apple had succeeded in getting a temporary injunction against Samsung for copying the iPad’s design. Apple also claimed that the reworked design was not sufficiently different, but the court has now rejected the argument.

A final ruling on the dispute is scheduled for February 9th, according to Reuters.
