Samsung Adds iPhone 5 to Patent Suit vs. Apple

After spending a couple of weeks examining the new iPhone 5, Samsung Electronics has added claims against the new handset from Apple Inc. (NASDAQ: AAPL) to its lawsuit alleging that Apple infringes on Samsung’s patents. The Samsung lawsuit is not scheduled to take place until 2014, by which time both companies will certainly have new models available which will either have been added to the suit or which won’t continue the alleged infringements.

Apple won a $1 billion award in a separate case against Samsung in September. Yesterday, Samsung won an end to a preliminary injunction forbidding the company from selling its Galaxy Tab 10.1 tablet in the U.S. The judge in the case imposed the preliminary injunction in June, but cancelled it following a jury verdict that Samsung had not infringed on an Apple design patent.

A December hearing is scheduled to evaluate Apple’s demand that Samsung be tagged with a permanent injunction from selling eight smartphone models and the Galaxy Tab 10.1. Samsung has also asked the court to toss the $1 billion award on the basis of juror misconduct, and that request is also scheduled to be heard at the December hearing.
